With a bouquet of attractive offers and promotions running on our site, it’s you, we want to be the winner all the way. While every product we host on the site is something we would want to wear and use ourselves, as they are handpicked and chosen ones, please be informed that not each of them is eligible for additional benefits in the form of coupons, promotions or offers. The coupons, promotions and offers apply on select merchandise only. You can refer to individual offer eligibilities on a product page, to choose what you like best.
If you choose to return or cancel purchase of any product, the amount that would be refunded to you would be the price on your invoice that you may have received after availing all offer benefits - (minus) the additional charges as mentioned in refund policy, please refer cancellation and refund policy. This will, of course, be subject to a sign-off from our QC team after inspecting the returned items.
Please note that Cozmya reserves the right to modify the terms and conditions of any of the offers or promotions offered on the Platforms at any given time.
1. About Cozmya
1.1 VHS Infotech Private Limited, having its registered office at RZ-7F/2A, Gali No. 3, Main Sagarpur, Delhi - 110046, Delhi, India (“VHS Infotech”, “we”, “us” or “our”) is managing and operating the website https://cozmya.com and its corresponding mobile/tablet applications (collectively referred to as “Cozmya”, or “Website”, or “App”), through which it inter alia facilitates the sale and purchase of various product sand associated services , offers, programs, functionality and other promotional activities ( “ services”) available on the platform to the end customer (collectively referred to as “Customer” or “User” or “Users” or “you” or “your”).
1.2 Only persons who can enter into legally binding contracts as per the Indian Contract Act, 1872, i.e., persons who are 18 years of age or older, are of sound mind, and are not disqualified from entering into contracts by any law, can use and access Cozmya. If you are a minor i.e., under the age of 18 years, you may use Cozmya, only with the involvement of a parent or guardian.
2. What is Cozmya promotion policy
2.1 Cozmya from time to time, may organise various promotions, contests, offers including discounts, vouchers, coupons, campaigns, and sales with respect to the Products sold on the Platforms. This Cozmya Promotions Policy, together with the terms and conditions, the privacy policy, the fee and payment policy, the delivery and shipping policy and cancellation, return and refund policy, set out Cozmya’s procedures and policies in offering promotions, contests, offers, discounts, vouchers, coupons, campaigns and sales on the Platforms from time to time (“Promotions”). In addition to this Cozmya Promotions Policy, any return of the Products by Users shall also be governed by, and be subject to the terms and conditions set out under Cozmya’s cancellation, return and refund policy.
2.2 Users are required to peruse and understand the terms of this Cozmya Promotions Policy. If you do not agree to the terms contained in this Cozmya Promotions Policy, you are advised to forthwith leave the Platforms. The terms contained in this Cozmya Promotions Policy shall be accepted without modification and you agree to be bound by the terms contained herein by initiating a request for purchase of Product(s) on the Platforms. If there is any conflict between the Cozmya Promotions Policy and any other policies of Cozmya, the Cozmya Promotions Policy shall prevail.
3. General terms of promotions
3.1 Cozmya may, from time to time offer various Promotions to its Users to create, encourage and sustain User interest in the Products. It is specifically clarified that all discounts offered by Cozmya as a part of its Promotions on the Products shall exclude all convenience charges including charges that may accrue on the delivery of the Products to the Users, if any.
3.2 Cozmya reserves the right to introduce the Promotions (individually or collectively) at intervals of its choice. While the general terms of this Promotions Policy sets out Cozmya’s terms and conditions governing all of its Promotions, Cozmya may also provide separate terms governing each one of its Promotions. While choosing to participate in the Promotions, the Users are, apart from this Promotions Policy, requested to peruse and understand the terms which govern individual Promotions. Cozmya may, at any time and without having to service any prior notice to the User, modify or delete its Promotions or the terms and conditions governing such Promotions.
3.3 Cozmya may provide the Promotions on a select range or on all of its Products. The Promotions may also be applicable on any, or certain specific purchases carried out by the User on the Platforms. Further, without having to service any notice on the User, Cozmya may withdraw all, or a part of its Promotions from the Platforms.
3.4 As part of the Promotions, Cozmya may offer the following offers on select Products on the Platforms: (a) Trade Discounts; and (b) Coupon Discounts and /or (c) other type of discounts. Notwithstanding the term of the Promotions, the Discounts will be operational only until stocks last or for a defined range of period, and Cozmya shall reserve the unconditional right to modify, suspend, or cancel any Discounts at any time.
3.5 Trade discounts are regular discounts which are provided by Cozmya for the benefit of Users from time to time. The trade discounts are independent of any other Promotions, and will be extended to only a select range of Products as indicated on the Platforms (“Trade Discounts”). The Trade Discounts shall offer discounts up to a certain percentage on the maximum-retail price (“MRP”) of the Products, and the User will only be required to pay the List price plus (+) any additional charges if applicable. The range of Trade Discounts offered on a Product may increase or decrease at any time during the term of the Promotions at the sole discretion of Cozmya, and Cozmya shall not be required to serve a prior written notice intimating such change in the range of discounts to the Users.
3.6 In addition to the Trade Discounts, Cozmya may also offer discount vouchers or coupon discounts on a select range of Products as indicated on the Platforms (“Coupon Discounts”). All Products available for sale on the Coupon Discount, may not necessarily have an applicable Trade Discount, and any combination thereof with Trade Discounts shall be at the sole discretion of Cozmya. Please note the discount amount or percentage mentioned under each Coupon Discount indicates the maximum discount that can be availed on the relevant coupon. The actual discount amount passed to the User when redeeming a coupon may vary depending on the nature of products, brands and/or category of product being purchases by the User. Therefore the actual discount availed by the User may be less than the maximum discount shown on the relevant coupon.
3.7 If Cozmya partners with any third party in connection with Promotions, any terms and conditions of such Promotions provided by the third party will also be applicable on such Promotions.
3.8 Cozmya reserves the right to cancel any purchase of the Products carried out using means including, but not limited to, invalid or unauthorized use of Promotions on the Platforms. Cozmya shall at all times have the right to initiate appropriate legal proceedings against any website, entity or individual engaged in unauthorized publication of information pertaining to the Promotions. The Discounts are non-transferable and have no cash value.
3.9 Cancellation and Return of Product - Subject to Cozmya’s cancellation, return and refund policy, if a User desires to cancel or return Products which have been purchased during the term of relevant Promotions, and such return has been accepted by Cozmya, the User shall be entitled to a refund of the amount paid by the User for purchase of the Products on the Platforms minus the charges. An illustration example for reference :
3.9.1 A User’s order reflects the purchase of a single Product whose MRP is INR 2,000, with a Trade Discount of 20%, and a Coupon Discount of 20%, and the User makes an online payment of a sum of INR 1,280 at the time of placing the order on the Platforms. Upon cancellation or refund of the Product in accordance with the Cozmya Promotions Policy and after deduction, a final amount of INR 1,200 will be credited to original mode of payment after the deduction of Rs 80 which are charges against the cancellation and refund of product. If the User had opted for prepaid orders, refund will be processed in the original mode of payment.
3.9.2 Similarly, A User’s order reflects the purchase of two Products: (a) the first Product whose MRP is INR 2,000, with a Trade Discount of 20%, and a Coupon Discount of 20%, totalling up to INR 1,280, and (b) the second Product whose MRP is INR 1,500, with no applicable Discounts. The User’s total spent amount will be INR 2,780. Upon return of the Product in accordance with the Cozmya Promotions Policy and after deductions, a final amount of INR 2,700 will be credited to original mode of payment after the deduction of Rs 80 which are charges against the cancellation and refund of product. If the User had opted for prepaid orders, refund will be processed in the original mode of payment.
3.9.3 In case the mode of payment is COD and cancellation or refund is initiated, in such a case with reference to Cancellation, return and refund policy, an additional COD convenience fee (+) plus the Rs 80/- charges, against the cancellation and refund of product will be deducted and balance will be transferred only in a valid user’s bank account.
3.10 As a part of the Promotions, Cozmya offers end of season sale/special sale events from time to time (“Special Sale”) which shall subsist only until stocks offered for Special Sale last. The Special Sale shall offer discounts on the MRP up to a certain percentage on select merchandise. The range of discounts offered on the Products may increase or decrease at any time during the Special Sale at the sole discretion of Cozmya and Cozmya shall not be required to serve a prior written notice intimating such change in the range of discounts to the Users.
3.11 Promotions may be combined only at the sole discretion of Cozmya. All Promotions are non-transferable and have no cash value. Without having to service a prior notice on the User, Cozmya reserves the sole right to extend or terminate the Promotions.
3.12 If the performance of Cozmya in respect of any of the Promotions is prevented or delayed due to any circumstances including but not limited to the incidence of computer viruses, tampering, unauthorized intervention, interception, fraud, technical failures, floods, fires, accidents, earthquakes, riots, explosions, wars, hostilities, acts of government or other circumstances of a similar nature beyond the control of Cozmya, Cozmya shall not be liable for the consequences of such non-performance.
3.13 By the User’s participation in the Promotions, the User agreed to indemnify and hold harmless Cozmya, its affiliates, officers, directors, employees, consultants, licensors, agents and representatives from any and all claims including reasonable attorney fees and costs arising out of the User’s participation in the Promotions.
4. Terms for specific promotion
The users will be able to avail different types of Coupon Discounts on the Platforms:
4.1 The First Purchase Offer is a promotional offer for all Users who are making their first purchase on the Platforms (“First Purchase Offer”).
4.2 Users may avail the benefit of the First Purchase Offer coupons only once or as otherwise specified in this Cozmya Promotions Policy.
4.3 The First Purchase Offer will commence on a date as notified on the Platforms, and will continue until the First Purchase Offer is discontinued by Cozmya.
4.4 The First Purchase Offer coupons are applicable on select Products sold on the platform.
4.5 The maximum discount that can be availed under any coupon under the First Purchase Offer will be set out in the relevant coupon.
4.6 Participation in this First Purchase Offer is purely voluntary.
4.7 You would be eligible for the First Purchase Offer only if you are about to make your first-ever purchase on the site. However, if you wish to cancel or return your purchase, you will no longer be eligible for availing this offer again.
4.8 The Promotional Coupons form a part of our Promotions and are made available to all eligible users who are transacting on the Platforms (“Promotional Coupons”).
4.9 The Promotional Coupons will be valid for the period as notified on the Platform.
4.10 The Promotional Coupons are applicable to select Products sold on the Platforms
4.11 Users may avail the benefit of the Promotional Coupons only once or as otherwise specified in these Cozmya Promotions Policy.
4.12 The maximum discount that can be availed under each Promotional Coupon will be mentioned in the relevant Promotional Coupon. The discount offered under the Promotional Coupons cannot be combined with any other offers, promotions or discounts offered by Cozmya (other than Trade Discounts).
4.13 Participation in Promotional Coupons is purely voluntary.
4.14 The Promotional Coupons may also be subject to additional terms and conditions as Cozmya may notify from time to time.
4.15 Certain coupons either under (i) First Purchase Offer; and/or (ii) Promotional Coupons may not be active from time to time.
We reserve full right to share the coupons on the product page, in the cart, in the checkout page, in the relevant policy, directly to customer via e-mail, messages, what’s app, or through promotion and marketing media and/or channels. The coupons nature may be first time, one time or for a specified period. We reserve the right to withdraw any coupon without any intimidation to user. Cozmya shall reserve the unconditional right to modify, suspend, or cancel any Coupons at any time.
5. Other Terms
5.1 Cozmya reserves the right to disqualify any transaction or extend, cancel, discontinue, prematurely withdraw, change, alter or modify the Promotions or any part thereof including the eligibility criteria and other pertinent terms and conditions at their sole discretion at any time as may be required, including in view of business exigencies and/or changes by a regulatory authority and/or statutory changes and/or any reasons beyond their control and the same shall be binding on the Users without prior notice.
5.2 In cases of fraudulent/suspicious transactions or if there is any technical glitch, Cozmya reserves the right to revoke the Promotions and disqualify any User from getting the benefits of the Promotions.
5.3 Cozmya does not accept responsibility for network, computer or software failures of any kind and has no responsibility for lost, delayed or misdirected entries.
5.4 Cozmya will not be liable for any loss (including, without limitation, direct, indirect, special or consequential loss or loss of profits) expense or damage which is suffered or sustained in connection with the Promotions including any loss incurred as a result of any delay and/or failure to perform any obligation to the Users that is caused by:
5.4.1 Technical problems of any kind which may limit or prevent any person's participation in this Offer
5.4.2 Loss or damage arising from or in connection with the allocation of discount
5.4.3 Any other events beyond Cozmya’s control that may cause the Promotions to be disrupted or corrupted or may lead to loss of, or damage to, the User.
5.5 User hereby agrees to indemnify and keep Cozmya/VHS Infotech Pvt Ltd harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings that may be suffered by Cozmya/VHS Infotech Pvt Ltd as a consequence of:
5.5.1 Violation of these terms and conditions by the User
5.5.2 Any action or inaction resulting in willful misconduct or negligence on the Users part.
5.5.3 Violation of applicable laws
5.6 User agrees that the Cozmya Promotions Policy shall be governed by and construed in accordance with the laws of India and the courts in Delhi shall have exclusive jurisdiction to decide over any controversy arising out of the Cozmya/VHS Infotech Promotions Policy.
